Privacy Policy
This Privacy Policy explains how SmashByte, Inc. (“SmashByte,” “we,” “us,” or “our”) collects, uses, and shares information through the Cutting Cap website, applications, and related communications (the “Services”). Cutting Cap is a brand operated by SmashByte, Inc. Please also read our Terms of Use.
Information we collect
We collect information you provide and information generated when you use the Services:
- Application, contact, and business information. This includes your name, email address, phone number, business name and address, industry, time in business, revenue and credit ranges, requested funding amount, and intended use of funds.
- Documents. This includes bank statements and other files you choose to upload, such as identification or a voided check.
- Optional bank-link information. If you choose to connect a bank account through our bank-link provider, we may receive connection identifiers, institution details, balances, transaction summaries, and other information made available through that connection.
- SMS opt-in records. If you register for text messages, we keep your mobile number, whether you opted in to service texts and/or marketing texts, the date and time of each opt-in, the consent wording and version you saw, and the IP address and browser user agent used to submit it. We also keep records of HELP and STOP requests.
- Device, usage, and attribution information. This includes IP address, browser and device details, pages visited, site interactions, referring URLs, advertising campaign parameters, and click identifiers.
How we use information
We use information to receive and process applications; review eligibility; support underwriting and verification; communicate about applications, offers, and our Services; provide customer support; maintain and improve the Services; measure site and campaign performance; prevent fraud and protect security; enforce agreements; and comply with applicable legal obligations. We may combine information collected through different parts of the Services for these purposes.
How we share information
We share information as needed to operate the Services and evaluate funding requests, subject to the text-messaging limits described in the Text messaging (SMS) section below:
- Funding partners. We may share your application, contact and business information, documents, and optional bank-link results with funding partners for underwriting, verification, review, and related follow-up. Their handling of information is governed by their own terms and privacy practices.
- Operational service providers. Vendors that provide email delivery, hosting, document storage, analytics, bank-link technology, security, and similar services may process information for us.
- Legal, safety, and business purposes. We may disclose information to comply with law, protect rights and security, enforce agreements, or in connection with a merger, financing, reorganization, or transfer of business assets.
Text messaging (SMS)
Our registration form offers two separate, optional text-message consents from Cutting Cap (operated by SmashByte, Inc.): (1) recurring automated service updates and account notifications (for example, funding application status and document requests), and (2) recurring automated marketing notifications (for example, business funding offers and cash offers on your home). You may choose either, both, or neither, and we record each consent separately. Messages start with "Cutting Cap:". Opting in is optional and is not a condition of any purchase or of obtaining funding. Message frequency varies. Msg & data rates may apply. Reply HELP for help or STOP to opt out at any time. Mobile numbers and SMS opt-in data and consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. We disclose this information only to service providers that help us deliver messages (such as our messaging platform and wireless carriers), and only to operate the text program, or when required by law. The sharing described elsewhere in this policy does not include mobile numbers or SMS opt-in data and consent for anyone's marketing or promotional purposes.
Communications and your choices
Where you provide consent, SmashByte, Inc. may contact you with informational or marketing communications by phone, email, or text message, as described in our Terms of Use. You can revoke consent to text messages by replying STOP to a text, revoke consent to calls by asking the caller to stop calling, or make a revocation request for either channel by emailing funding@cuttingcap.com. You may also use an unsubscribe link in a marketing email. Withdrawing marketing consent does not affect your ability to apply for funding.
Retention and deletion
We retain information for as long as reasonably needed for the purposes described above, including application processing, recordkeeping, security, dispute resolution, enforcement of agreements, and legal compliance. To request deletion of your information, email funding@cuttingcap.com. We may take steps to verify your request. Deletion is subject to legitimate retention needs and applicable legal requirements, so some information may be retained even after a request.
Security
We use Transport Layer Security (TLS) to help protect information transmitted between your browser and our sites. No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
Cookies and analytics
We and our service providers may use cookies, local storage, pixels, and similar technologies to remember your progress, understand how visitors use the Services, measure campaigns, and support security and analytics. These technologies may collect device, usage, and attribution information. You can control some cookies through your browser settings, but blocking them may affect site functionality.
Business use and age
The Services are intended for business purposes and for individuals who are at least 18 years old and acting on behalf of a business. They are not directed to children, and we do not knowingly collect personal information from children under 13.
Updates to this policy
We may update this Privacy Policy as our Services or practices change. We will post the revised policy on this page and update the “Last updated” date. Your continued use of the Services after an update is subject to the revised policy.
