These Terms & Conditions (“Terms”) govern your use of the Cutting Cap website, applications, and related services (the “Services”). Cutting Cap is a brand operated by SmashByte, Inc. (“SmashByte,” “we,” “us,” or “our”). By using the Services, submitting an application, or electronically signing through the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Business eligibility and accurate information
You must be at least 18 years old, authorized to act for the business identified in your application, and using the Services solely for business purposes. You agree to provide accurate, current, and complete information and documents, to update them when needed, and not to misrepresent your identity, authority, business, or financial circumstances.
Electronic records and signatures
You consent to receive application materials, disclosures, agreements, and other communications electronically. You agree that electronic signatures, clicks, and records may be used to evidence your approvals and agreements to the same extent as paper signatures and records, subject to applicable law. You are responsible for maintaining the ability to access and retain electronic records and should save copies for your files.
Applications and funding-partner review
When you submit an application or documents, you authorize SmashByte, Inc. to review and verify the information you provide and to share your application, contact and business information, documents, and optional bank-link results with funding partners for underwriting, verification, review, and related follow-up. A funding partner may apply its own criteria and request additional information. Any final offer or agreement will come from the applicable provider and will be governed by its own terms.
Communications consent
Text messages about your funding request are covered by the SMS text messaging terms below. Separately, by providing your phone number and expressly agreeing where prompted, you consent to receive informational and marketing calls and SMS/MMS messages from SmashByte, Inc., including communications regarding Cutting Cap, at the number you provide. These communications may be made using automated dialing technology and prerecorded or artificial voice. Message frequency varies, and message and data rates may apply. Consent is not a condition of purchase or of obtaining funding.
You may revoke consent at any time. To stop text messages, reply STOP to a text. To stop calls, ask the caller to stop calling. You may also revoke consent for calls or texts by emailing funding@cuttingcap.com. Revoking marketing consent does not affect your eligibility to apply or receive funding.
SMS text messaging terms
These SMS terms apply to the Cutting Cap text-message program (the “SMS Program”). Cutting Cap is operated by SmashByte, Inc.
- Program description. When you opt in on our registration page, you choose two separate, optional consents: (a) service updates and account notifications, such as funding application status, document requests, and account notices; and (b) marketing notifications, such as business funding offers and cash offers on your home. Each consent is recorded separately with its own date and time, and you may give either, both, or neither. Opting in is optional and is not required for purchasing products or services or obtaining funding. Every message starts with "Cutting Cap:", for example: "Cutting Cap: We got your funding application. We'll text status updates here. Msg & data rates may apply. Reply HELP for help, STOP to opt out."
- Message frequency. Message frequency varies depending on your request and its status.
- Costs. Msg & data rates may apply. Contact your wireless carrier for details about your plan.
- Help. Reply HELP to any message for help, or email funding@cuttingcap.com.
- Opting out. Reply STOP to any message to opt out. We will send one message confirming that you have been unsubscribed, and you will receive no further texts from the SMS Program (service or marketing) unless you opt in again. You may also opt out by emailing funding@cuttingcap.com.
- Carriers. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed.
- Eligibility and your number. You represent that you are the subscriber or authorized user of the mobile number you provide. If your number changes or is reassigned, reply STOP from the old number or contact us so we can update our records.
- Privacy. Our Privacy Policy explains how we handle your information. Mobile numbers and SMS opt-in data and consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes.

Revenue purchases and no guarantees
A revenue purchase is a purchase of future business receivables, not a loan. Website examples and preliminary options are not final offers. Approval, amounts, rates, terms, and funding timing depend on review and final documentation. We do not guarantee approval, any particular rate or terms, or funding within any particular time.
Calculators and general information
Calculators, guides, examples, and other site content are provided for general informational purposes only. Results are estimates and may not reflect an available offer or your actual costs and obligations. The content is not legal, tax, accounting, investment, or other professional advice. Consult a qualified professional about your specific circumstances.
Acceptable use
You agree not to use the Services to violate law or another person’s rights; submit false, fraudulent, or unauthorized information; upload malicious code; attempt to gain unauthorized access to systems or data; interfere with the Services; or use automated means to extract site content without our permission.
Intellectual property
The Services, including their design, text, graphics, logos, and software, are owned by SmashByte, Inc. or its licensors and are protected by applicable intellectual property laws. We grant you a limited, revocable, non-exclusive right to use the Services for their intended business purpose. You may not copy, modify, distribute, sell, or create derivative works from the Services except as permitted by law or with our written permission.
Third-party services
The Services may rely on or link to third parties, including funding partners, bank-link providers, analytics providers, and communication services. Third-party offerings are governed by their own terms and privacy practices. Your interactions with a third party are between you and that party, and we are not responsible for third-party websites, content, or services.
Disclaimers
To the maximum extent permitted by law, the Services and their content are provided “as is” and “as available.” We disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy. We do not warrant that the Services will be uninterrupted, error-free, or secure.
Limitation of liability
To the maximum extent permitted by law, SmashByte, Inc. and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to the Services. Our aggregate liability for direct damages arising from or related to the Services will not exceed US$100. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
Changes to these Terms
We may revise these Terms by posting an updated version on this page and changing the “Last updated” date. Changes take effect when posted unless we state otherwise. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
